Is DAS UK going to be operationally impacted Brexit?

With the final detail of how Brexit will impact the UK yet to be resolved due to the ongoing negotiations between the EU and UK Government, we await a decision on whether the UK’s regimes will be given equivalence by the EU in areas such as data protection. Through the work undertaken since the decision by the UK to leave the European Union, we are confident that DAS UK has adequately prepared for this event and will continue to operate without Brexit affecting the experience of our customers or business partners. ERGO, our parent company, and Munich Re (ERGO’s majority shareholder) have also reiterated their commitment to the UK market.

How might Brexit affect DAS UK?

At the end of the transition period, the regulatory landscape and authorisation for insurance may change and this will affect DAS UK. Obviously there are a lot of uncertainties. For example - if the UK leaves the EU with a deal, what will the deal look like? Or will there be no deal? We have assessed the potential Brexit impacts and taken the approach of limiting our current exposure to only insuring risks that are UK domiciled. External advice has been taken on this approach and we are confident this will best protect DAS UK and our customers in the event of a no deal scenario.

What does DAS UK mean by a UK domiciled risk/subject matter of insurance?
  • For commercial legal expenses and assistance products, this means the business buying the insurance must be a UK registered or UK based business.
  • For personal legal expenses and assistance products (other than home emergency) this means the main residence of the individual buying the insurance must be in the UK.
  • For landlord and home emergency products this means the property the insurance is bought for must be in the UK. The main residence of the individual buying the product can either be in the UK or overseas. This includes overseas landlords with a UK property.
Does ‘UK domiciled’ include England, Scotland, Wales, Northern Ireland, Channel Islands and Isle of Man?

Yes, where the term ‘UK domiciled’ is used it includes these territories.

For motor cover does it matter where the vehicle is registered?

No, the DAS UK approach on UK domiciled is to look at the UK business or individual being insured. It does not look at where any motor vehicle being insured is registered or stored. In practice we would expect the majority of motor vehicles (or any other asset being insured) to be located in the UK.

Is the market taking the same approach as DAS UK on Brexit?

The assumptions around Brexit are untested. Others in the market may take a different approach to defining risk/subject matter of insurance depending on the nature of their business and advice they have received. External advice has been taken on our approach and we are confident this will best protect DAS UK and our customers in the event of a no deal scenario. Any business partner should raise specific questions with their DAS UK Account Manager.

Do you still provide cover for insured incidents such as personal Injury, legal defence and contract disputes cover outside of the UK?

Yes. There is no change to cover for insured incidents, services, helplines and assistance that we provide outside of the UK.

How will Brexit affect GDPR, DAS UK’s data etc?

We are not expecting Brexit to impact on GDPR or DAS UK’s data.
