To establish who is at fault (liability) and to determine if you are more likely than not to recover your losses.
At this point, we will provide advice on the losses you can claim for, the services we can offer and the documentation you need to provide to support your claim.
Our recoveries team will immediately start investigations with all parties involved including insurers to avoid any delays in progressing your claim.
The team will keep you updated on the progress of your claim.
If you or any passengers in your vehicle were injured in the incident, we will appoint a specialist injury lawyer to help and support you to get the compensation you deserve.
Your dedicated claims handler will review your claim and offer specialist advice.
Losses may include a policy excess payable under your general motor policy, the cost of public transport or hire vehicle costs and loss of earnings you may suffer. These are referred to as uninsured losses.
Your handler will then present your loss to the at-fault party and/or their insurers requesting payment of the agreed losses.
We will also keep you updated throughout the claim so you know what is happening.
In the vast majority of cases, we’re able to reach a resolution of your claim quickly. We will address all liability issues and negotiate the best settlement possible for you.
However, in a small number of cases it may be necessary to take a stronger approach - if this is the case we will appoint a preferred DAS Solicitor.
If court action is needed
In our experience, the majority of cases settle without the need to go to court.
Settlement occurs when both sides come to an agreement on how to end the dispute without having to go to court.
However, if your case can’t be settled and needs to go to court we’ll support you throughout the process by explaining what will happen at each stage, informing you of any action you need to take and employing a barrister to represent you at the hearing.
Generally, legal issues do take time to resolve but the more prepared we are the quicker the process will be.

Freedom of choice
When court proceedings are issued or there is a conflict of interest, you are free to choose whether you use the lawyer appointed by us or your own to represent you.
It is important to know we will only pay your chosen lawyer the same amount we would our preferred lawyers. Typically this amount is £100 per hour.
If you choose to use your own lawyer and their costs are higher than this, you will have to pay the difference.
